COVID-19 and Renters

CARES Act and Renters

On March 27, 2020, the President signed the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”) into law. This law also includes an eviction moratorium. A detailed summary is available here.

The highlights are:

  • As of March 27, 2020, renters living in public housing, other federally subsidized housing, and housing with federally-baked mortgage loans should not be evicted for 120 days. Once that 120 days is up, landlords must give renters 30 day notice to evict.
  • During this 120 day period, landlords subject to this law may not charge late fees or other penalties.
  • Payments are not forgiven; they will still come due.

  1. As of March 25, 2020 all evictions are suspended. Law enforcement officers are directed not to enforce residential evictions until the Kentucky state of emergency is over.
  2. As of March 17, 2020, all non-emergency civil cases are postponed through April 10, 2020. This includes evictions.
  3. Your landlord should not take actions to force evictions, such as changing the locks or cutting off utilities. If they do, there may be a judicial remedy.
  4. Unless your lease states otherwise, a landlord must provide one month's written notice before you are required to move.
  5. A landlord may not evict you without a court order. However, your rent will still be due during the state of emergency.
